Following the judgment and subsequent advice by Supreme Court counsel, the Foundation decided initiate Supreme Court appeal against the judgment of the Court of Appeal of 23 December 2025.

The Foundation believes that the Court of Appeal imposed overly strict requirements regarding the extent of the Foundation's control over the legal action at the core of these proceedings. It is vital that this appeal judgment is annulled by the Supreme Court, in the interests of investors who held shares in Airbus SE and would also be important for the general functioning of representative organisations.

The funder has committed to fund the proceedings before the Supreme Court. The deadline to initiate this appeal is 23 March 2026.The Foundation views these proceedings with confidence.

Investors do not need to take any action at this stage and will be updated in due course.
