Court of Appeal issues judgment in appeal proceedings

Today, the Court of Appeal of The Hague issued its judgment in the collective action against Airbus, its responsible executives and auditor. Stichting Investor Loss Compensation initiated legal proceedings on behalf of institutional and retail investors to recover losses incurred because of Airbus' involvement in bribery and misconduct. The losses amount to more than €300 million.
 
The court upheld the initial ruling by the District Court of The Hague, which had declared the Foundation to be inadmissible. The court has stated that the Foundation does not adequately safeguard the investors' interests due to the financial arrangements it has made with its service providers and litigation funder. While it is customary for courts to offer interest organisations such as the foundation the opportunity to address issues in their governance, the court did not grant the foundation this opportunity. The Foundation is currently studying the judgment and will decide in due course whether to initiate cassation proceedings.

Investors who are registered with the Foundation do not need to take any action at this stage and will be updated in due course.
